These terms and conditions, and the relationship between you and us (whether contractual or otherwise) shall be governed by, and construed in accordance with, the governing law of United Kingdom.
1. These terms and conditions outline the rules and regulations for the use of Vigour Fitness Group Ltd (www.New HorizonCrossFit.co.uk), located at Unit 4 & 5, Yor House, Old Hatfield, AL9 5AD. By accessing or using our services, you signify that you have read, understood, and agree to be bound by these terms of use agreement (“agreement”) and to the collection and use of your information as set forth in the privacy policy, whether or not you are a registered user of our service.
2. We reserve the right to amend this agreement at any time by notifying you as provided in this agreement, provided that no notice shall be required for non-substantive changes to the agreement.
3. The following terminology applies to these terms and conditions, privacy statement and all agreements: “client”, “you” and “your” refers to you, the person log on this website and compliant to the company’s terms and conditions. “the company”, “ourselves”, “we”, “our” and “us”, refers to our company. “party”, “parties”, or “us”, refers to both the client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the client in the most appropriate manner for the express purpose of meeting the client’s needs in respect of provision of the company’s stated services.
For the avoidance of doubt, New Horizon CrossFit may hereby referred to as Vigour Fitness Group Ltd and are one and the same.
Terms and Conditions
All services purchased from New Horizon CrossFit must be preceded by the applicant acknowledging, by way of completing a digital waiver on the Zen Planner Members Portal, that he/she has no physical limitations preventing him/her from participation. All applicants under the age of 18 years must have consent, in written form, from a parent or guardian. The applicant also agrees to abide by the rules and regulations of the Vigour Fitness Group Ltd /New Horizon CrossFit and acknowledges that these rules and regulations may change from time to time. Furthermore, all applicants release Vigour Fitness Group Ltd, its owners, Directors, Managers and all employees and staff of all liability regarding 1) any injury to self or child 2) any loss or damage to personal property. If purchasing packages that require payments to be made in instalments, the applicant agrees to approve such instalments be made by credit card on the dates as predetermined in the services contract.
Membership
Membership is on a rolling one-month basis, with a two-month minimum commitment up front. Once a membership is taken out, membership shall automatically continue from month to month at the prevailing membership rate, which is subject to change, until I contact New Horizon CrossFit (Vigour Fitness Group Ltd) in writing to cancel via the cancellation form. You are responsible for all charges billed or incurred prior to cancellation. Please see cancellation policy below if you wish to end your contract with Vigour Fitness Group Ltd / New Horizon CrossFit.
Bulk Buy memberships are one off payments, with 5 classes to be used within a two month period for the date of purchase. After all the classes are used or two months have passed (whichever is earliest) the Bulk Buy will not renew.
Registration & Purchase
To register or purchase from the New Horizon CrossFit’s online booking system Zen Planner, you must be over eighteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete.
Monthly memberships are on a one month rolling basis, paid via debit or credit card, through Pay Safe. There is a two month minimum term for initial monthly memberships, after which it is a one month rolling membership.
Refund & Cancellation Policy
All monthly fees must be paid in full, regardless of usage. There is no refund in whole or in part. Memberships are non-transferrable. Management reserves the right to refuse membership or admission, or to withdraw membership at their discretion. If you pay for a month and cannot attend you are not entitled to a refund or extension. You are free to upgrade your membership from month to month by choosing and paying for a different package. Owners of New Horizon CrossFit (Vigour Fitness Group Ltd) hold the right to increase monthly membership prices. Notice will be given to all members at least 30 days in advance of any changes. Cash membership payments are not accepted except as a one-off by prior agreement.
Hold instead or cancel membership
If you would like to put your membership on hold instead of cancelling, you can submit a Membership Hold Request . Membership can be held for a maximum of two months and can be requested once within a 12 month period. If you’re sure you’d like to cancel, just complete and submit the Cancel Membership form on our website. This will serve as your 30-day written cancellation notice as required by your membership agreement. Your membership will be cancelled 30 days from the submission of the form below. Note that if you have a scheduled payment within this period, the payment will be processed as scheduled. All payments are non-refundable.
Early Termination of contract
Cancellation of memberships prior to the expiration of any specified commitment period requires an early termination fee . If I choose to sign a contract, and then choose to cancel that membership before the contract has expired, I agree to pay a termination fee equivalent to value of the outstanding contract. This is the case unless written authority that states otherwise is given by/from New Horizon CrossFit (Vigour Fitness Group Ltd).
Classes
Booking in: You can book up to one week in advance and up to two hour prior to class commencing.
Cancellation: 6 hours’ notice is required for cancellation of single classes. Missed classes without the appropriate notice will be charged as if attended.
